Having attended your ``Fixing the RMA'' hui recently at the Milson Office of Simon Power I wish to respond from a Maori perspective as to my concerns to the current RMA Act and your intentions to make changes to it.

Firstly all Parliamentarians and the ``Crown'' need to understand the past. On the 5th of February 1840 the power base of Maori was Whanau / Hapu / Marae, not ``Incorporated Societies'', ``Iwi Authorities'' or ``Runanga'' . When the Treaty was signed on the 6th of February nothing changed within Maoridom. What did change was the implementation of ``Crown Laws'' which was to breakdown the Traditional Maori Structures. When occasions warranted it several Whanaunga Marae came together to hold a ``Runanga Hui'' on issues pertaining to their takiwa.

The RMA Act loosely refers to consultation with Maori as a Treaty obligation and leaves that process to the Individual Local Government Body who often acknowledges the self anointed, self appointed representative for all Maori within the Local Authorities Boundary. A case in point was the recent disruption in Tainui where a consent was given by the ``Iwi Authority'' in Hamilton for the Iron Sands on the Coast and the Local Marae in the area concerned had no input into that decision. When they retaliated, they where displayed in bad light by the News Media reports, and after consultation and the truth was known, no apologies where forth coming once again leaving Maori to carry the burden of being disruptive to the RMA Act.

To negotiate a Treaty Settlement with the Office of Treaty Settlements one needs to meet the requirements of the 9 Sections of the Deed of Mandate Check List. At Local Government Level this is not a requirement, thereby allowing the self anointed, self appointed ``Incorporated Societies'', ``Iwi Authorities'' or ``Runanga'' to operate against the Traditional Maori Structures of Whanau / Hapu / Marae. Evidence of this can be obtained from the consultation methods of the Manawatu District Council/Manawatu Wanganui Regional Council and the many objections placed upon them

Against the common concept that the Crown will only deal at ``Iwi'' level they have set a precedence by allowing Three Hapu to settled their Claims (against Doug Graham's claim they wouldn't) one hapu being Rangi Te Kua (Central plateau), I believe this signifies it is time to return to the Traditional Structures of Maori and allow every Whanau / Hapu / Marae exercise their right of tangata tiaki/kaitiaki of their taikiwa and bring together Whanaunga Marae to hold a ``Runanga Hui'' on wider issues. . This is only the ``Readers Digest'' version as to many other issues within the RMA Act but a point I feel strongly about and I am prepared to meet with any committee you may appoint in the future.
